Subject: Family Medical Leave Act

I am a California state employee. I just found out that I cannot get FMLA while being a caregiver to my boyfriend who is undergoing treatment for tonsil cancer because we are not married.
Does anyone have any experience with this in California?

I live in Indiana, and a few years ago, my daughter, who was over 18, had thyroid cancer, and because she was over 18 I could not get FMLA to take care of her, even tho she lived at home and had a small child, FMLA is only for your husband or children under 18, or a parent, I had to take a leave of Absence at the time, I guess those are the rules for FMLA, sorry wish I could help you better, Pat

Fortunately my bosses have been great BUT I have use all my time and then my coworkers are donating time to me. And to top it off, my boyfriend was denied short-term disability because his last job did not pay into the system AND he had just started a new job when he got a diagnosis.

Oregon has another form of FMLA that includes domestic partners. Good luck and take care.

I too work for the state of California. You can qualify for FMLA if he has lived with you over 12 months. Also check into catastrophic leave.

Even if your not married you can get FMLA. You hve been taking care of him over a year. Talk to your HR Department. Possibly the senior or Supervisor. You do qualify for FMLA if your partner has lived with you over a year and your his provider. Don't give up. Your in my prayers... YOu can also request catastrophic leave from other state agencies. Go to your Union rep and inform them your in hardship and want your request for catastrophic leave credits to be state wide. OR you can go to other state agencies and ask that they publisize your request because of your hardship. Just a suggestion... Again good luck

I have enough catastrophic leave for 2 more months. I am a union rep and my LRO says they are right but I didn't know about the 1 year thing. I will check it out. Thanks.

I was informed as a atate employee I was eligible there was certain criteria that must be met: you have to worked 1250 hours in the last 12 previous moths, be a permanent full time employee, give employer 30 day notice if forseeable, ( notice with 2 workingdays is not foreseeable-except for extradinary conditions): must provide medical certification. Depending on your contract unit. you may want to check into this if he is your fiance'. significant other..
