I agree with Barry it was an accepted practice at the time it was not done to cause harm to anyone. When I had my first scan done back in the 70's I joked with the nuclear medicine dr that I will get another recall in twenty years because this causes something. He said you never know. The Drs only can do what is available at the time for treatment and this was a standard treatment. I have never felt suing someone was a logical thing to do when it was an accepted medical procedure at the time. Drs after all are human and can only practice in the realm of what knowledge is available at the time. Hindsight is always 20/20. Jane

TONS OF SENIORS DO NOT HAVE INSURANCE OR ARE NOT OLD ENOUGH FOR MEDICARE. BUT AGAIN.. YOU ARE ENTITLED TO YOU OPION JUST AS WE ALL ARE.

I FORGOT TO ADD THAT ALSO, IT WAS A THOUGHT AT THE TIME OF THE MDA THAT THESE TREATMENTS WOULD ALSO STOP CRIB DEATHS, BUT NEVER DID ANY RESEACH BEFORE DECIDING TO ADMINISTER THEM TO THOSE OF US THAT HAD THEM. WHY SHOULD WE BE HELD ACCOUNTABLE UNTIL THEY 20 YEARS LATER DECIDED.. WELL THIS IS NOT WORKING. DID THEY BOTHER TO ASK OUR PARENTS ABOUT WANTING THEM... NO.. I am supportive of investigating legal action and wonder if those who are interested should find a different format to communicate. it would be interesting for others to weigh in. I am about 3 years out from cancer treatment, and have to say before experiencing cancer I probably would feel like there was nothing to pursue. By the arguments some have made there would be no medical malpractice. No one sets out to do harm, but harm is sometimes done. There are tremendous expenses involved with illness, and it is ongoing. I do not have a completely clean bill of health and I hold my breath every time I have to go for a check up. I need to go this week for an ultrasound of my abdomen and hopefully they don't find anything too concerning. We could maybe set up a separate yahoo group for those who might be interested in pursuing legal action. My email is joyceklima@aol.com if anyone want to contact me.

L hate to disappoint you guys in legal action mode but this was the "standard of care" at the time.  I had the radioation also and have been lucky-no cancer.

I have never posted on this message board before, but have been reading with great interest because I also had infant radiation for an enlarged thymus. 

First, let me give the following information:  I have multinodules in thyroid from (most likely) the radiation.  Have a history of breast cancer on the left side and right side 2 years apart (had mastectomies).  Now have Radiation Keratosis from accumulation of ionizing radiation which started, of course, with the thymus radiation. 

With respect to the Radiation Keratosis, I saw a dermatologist who specializes in skin cancer and she said the situation is chronic and will need treatments 2 to 3 times per year for the rest of my life.  I just had one type of treatment which does not appear to have worked, but that issue I can go into later if anyone is interested.

I wanted to post with respect to the legal discussion regarding a class action.  I was a former legal secretary and believe I can help.  First, there has to be negligence before any lawsuit can be filed.  What that means is  a doctor or medical professional has to know what they are doing is not right (wrong) but does it anyway.  An honest mistake is not considered negligence.  In my humble opinion, there was no negligence.  Regardless of the standard of care issue, they were not aware the amount of radiation was excessive.  It was only thru the years that it became known that the machines emitted excessive amounts of ionizing radiation. With respect to the statue of limitations, that does not start until the discovery of an issue.  The manufactures of the machines would have been the parties legally responsible thru a chain of liability situation, however, as I mentioned before, they could not have known that what they were doing would cause damage.  Even if it were experimental, I am sure the parties involved would require a liability waiver exempting any future legal action.  Hope this info helps. 

I do hope to make friends with a lot of you.  I could use the support.  I need to locate physicains who (other then Rochester) treat ionizing radiation medical problems.
